2026 Claim Alert: Don’t Miss Critical Deadlines on 2024–2025 Property Claims

As time passes, many property insurance claims from 2024–2025 are quietly approaching deadlines that can significantly impact how much money is ultimately recovered. These deadlines are written into insurance policies, and once they pass, recovery options may be permanently lost.

If you still have open, unresolved, or partially paid claims from the past two years, now is the time to review them.

Why These Deadlines Matter

Insurance policies are contracts. While carriers are required to follow them, policyholders must also meet specific requirements and timelines. Missing a deadline does not usually come with a warning. It often results in denied payments or lost leverage.

Here are the most common deadlines that affect property claims.

1. Suit Limitation Deadlines

Most property insurance policies include a Suit Limitation provision. This sets a strict time frame, often 12 to 24 months from the date of loss, for when legal action can be taken related to a claim.

Once this deadline passes, the right to challenge underpayment or denial may be gone entirely, even if damage or disputes still exist.

This deadline can be found in your policy and varies by carrier and policy form.

2. Recoverable Depreciation Deadlines

Many claims are initially paid at Actual Cash Value (ACV), with depreciation withheld until repairs are completed. This withheld amount is known as recoverable depreciation.

To receive it, most policies require:

  • Repairs to be completed
  • Proof of completion to be submitted
  • Documentation to be provided within a specified time frame

If documentation is submitted late, the depreciation may no longer be recoverable, even if repairs were properly completed.

3. Replacement Cost (RCV) Recovery Windows

Replacement Cost benefits are typically tied to:

  • Completed repairs
  • Accurate invoices
  • Final documentation submitted before policy deadlines

If repairs were delayed due to contractor availability, supply chain issues, or disputes with the carrier, those delays can still affect RCV eligibility unless handled correctly.

Common Scenarios We’re Seeing

  • Claims that were paid partially and never revisited
  • Depreciation that was never claimed after repairs
  • Disputes over scope or pricing that stalled progress
  • Repairs completed, but paperwork never submitted
  • Deadlines approaching with no clear next steps

These situations are far more common than most property owners realize.

What You Should Do Now

If you have claims from 2024 or 2025, consider taking the following steps:

  • Review all open or previously paid claims
  • Confirm policy deadlines before time expires
  • Gather proof of completed repairs and invoices
  • Submit depreciation and supplements promptly
  • Consider Appraisal if there is a disagreement on scope or pricing
  • Engage a Public Adjuster to protect your interests and maximize recovery

Waiting until a deadline passes often removes options. Acting early preserves them.
